1.              RFP For Professional Services

Supervisor informed that given a re-organizational meeting this coming January that the town will go out for RFP for the professionals.

2.              Motion To:              Waive Fee as a result of a Water meter/Billing issue

COMMENTS - Current Meeting:

Supervisor Jiava explained that due to faulty radio reads from an improper installation, a gentleman in the water district who always had a low bill received a much larger bill once the radio system was put in.  She said, "The bill was three quarters, I believe, and the total was approximately $200."  Councilman Ciccarelli asked what the difference in the average billing that he had prior and that should be waived.  Supervisor Jiava said that it is on the paperwork that she handed out to the board identifying the radio reads.  Councilman Kuzmicz asked if we could get a definitive answer on this.  Supervisor Jiava said that they really cannot get that definitive an answer, but the meter was receded.  Councilman Beale moved to waive a fee.  The board agreed.  The resident's name was not mentioned.

4.              Conservation Park Districts

Al Roberts explained that there are 3 conservation park districts in the town.  He suggested funding the park district by the people who own the park to pay for maintenance versus having the general overall town's tax people pay for it, who have been paying for it by default.  He noted that Fieldstone is 700 parcels.  The discussion continued at length regarding many other parks and districts that are restricted and unrestricted.  Councilman Beale suggested discussing it at a future meeting.

RESOLUTION:              2017-152

 

Resolution Scheduling Town Board Meetings To Adopt Budgets For Fiscal Year 2018

 

WHEREAS, the Town Supervisor, as Budget Officer, pursuant to § 106 of the Town Law, has prepared the Tentative Budget for delivery the Town Board for review, examination and possible revision; and

WHEREAS, said Tentative Budget will be submitted to the Town Clerk on or before September 29, 2017, as required by law; and

WHEREAS, a Special Town Board meeting will be scheduled for Monday, October 2, 2017 at 7:30 p.m. for the purpose of having the Town Clerk deliver the Tentative Budget to the Town Board in accordance with Town Law § 106; and

WHEREAS, New York State Town Law § 108 requires that the Town Board must hold a public hearing on the Preliminary Budget on or before the Thursday immediately following the general election in November; and             

WHEREAS, Town Law requires the adoption of a Final Budget on or before November 20, 2017; and

WHEREAS, in order to accomplish the Budget Adoption Schedule set forth in Article 8 of the Town Law, the Town Board hereby establishes the following tentative schedule of Town Board Meetings set forth below, reserving unto itself the right to change the scheduled meetings if circumstances require.

NOW, THEREFORE, BE IT RESOLVED, as follows:

1.              The Town Board hereby schedules the following meetings of the Town Board to be held at the Town Hall, 20 Middlebush Road, Wappingers Falls, New York, commencing at 7:30 p.m. on the following dates for the purpose of examining, discussing, deliberating and adopting the Town Budget for calendar year 2018, reserving unto itself the right to change the scheduled meetings if circumstances require.

RESOLUTION:              2017-153

 

In The Matter Of The Establishment of a proposed water district extension in the Town of Wappinger, Dutchess County, New York to be known as Extension No. 6 (Tall Trees Extension) to United Wappinger Water District of said Town

 

WHEREAS, the Town Board of the Town of Wappinger, Dutchess County, New York (the “Town”), has duly caused to be prepared a map showing the boundaries of a proposed water district extension in said Town, to be known as Extension No. 6 (Tall Trees Extension) to United Wappinger Water District of the Town of Wappinger (hereinafter, the “Tall Trees Extension to United Wappinger Water District” or simply, the “Extension”) a general plan to serve said Extension, and a report of the proposed method of operation thereof, including capital improvements therefor and an estimate of cost thereof; and

WHEREAS, said map, plan and report, including an estimate of the cost, were prepared by Morris Associates Engineering & Surveying Consultants, PLLC, competent engineers duly licensed by the State of New York, and have been filed in the office of the Town Clerk of said Town, where the same are available during regular office hours for examination by any persons interested in the subject matter thereof; and

WHEREAS, the boundaries of said Extension shall be as described in Exhibit A attached hereto and hereby incorporated herein, being the boundaries of the Tall Trees Water Improvement Area; and

WHEREAS, the improvements proposed for said Extension consist of the installation of an 8” water main with pressure reducing valve vault, including original equipment, machinery, apparatus, appurtenances, land or rights-in-land, and incidental improvements and expenses in connection therewith, all as more fully described in the map, plan and report herein before described; and

WHEREAS, the maximum estimated cost of said improvements is $621,400; and

WHEREAS, of said maximum estimated cost, $375,000 is expected to be paid with grants-in-aid monies to be received by the Town; and

WHEREAS, of said maximum estimated cost, $246,400 of bonds and/or notes of said Town are expected to be issued to pay for the remaining maximum estimated cost of the improvements in connection with the establishment of said Extension; and

WHEREAS, the estimated cost of the connection to the typical property in said Extension, being a residential single family home therein, to the water main is $ 0; and

WHEREAS, the estimated cost of said Extension to the typical property therein, being a residential single family home therein, is $593.00 in the first year in which operation, maintenance, and other charges and expenses are to be paid by said properties as set forth in the map, plan and report (and would be $821.86 if the anticipated grants were not received therefore); and

WHEREAS, a detailed explanation of the manner by which said estimated costs of connection costs and first-year costs to the typical property were computed has been filed in the office of the Town Clerk in Wappinger Falls, New York where the same are available during regular office hours for examination by any person interested in the subject manner thereof; and

WHEREAS, said capital project for said Extension and the establishment thereof has been determined to be a Type II Action pursuant to 6 N.Y.C.R.R. § 617.5(c)(11) as it is an extension of water distribution facilities to render service in an approved subdivisions; and

WHEREAS, it is now desired to call a public hearing upon the question of the establishment of said Extension and the improvements proposed therefor, all pursuant to Section 209-d of the Town Law;

NOW, THEREFORE, BE IT ORDERED, by the Town Board of the Town of Wappinger, Dutchess County, New York, as follows:

Section 1.              A meeting of the Town Board of the Town of Wappinger, Dutchess County, New York, shall be held at the Town Hall, 20 Middlebush Road, in Wappinger Falls, New York, in said Town, on the 10th day of October, 2017, at 7:30 o'clock P.M., Prevailing Time, for the purpose of holding a public hearing to consider the establishment of a water district in said Town as described in the preambles hereof, to be known as the Tall Trees Extension to United Wappinger Water District of the Town of Wappinger, and the improvements proposed therefor, the boundaries hereof being as set forth in Exhibit A hereto, the method of assessment therein, and to consider the map, plan and report filed in relation thereto, and to hear all persons interested in the subject matter thereof concerning the same, and for such other action on the part of said Town Board as may be required by law or shall be proper in the premises.

Section 2.              The Town Clerk is hereby authorized and directed to cause a copy of this order to be published once in the official newspaper(s) of said Town, the first publication thereof to be not less than ten nor more than twenty days before the day set herein for the hearing as aforesaid, and said Town Clerk shall also cause a copy thereof to be posted on the sign-board of the Town maintained pursuant to subdivision 6 of Section 30 of the Town Law and on the website of the Town not less than ten nor more than twenty days before the day set for the hearing as aforesaid.  The Town Clerk is further authorized and directed to cause notice of said public hearing to be mailed by first-class mail to all property owners in the proposed Extension.

Section 3.              This Order shall take effect immediately.
